Grants bail to three accused as cops fail to file chargesheet in time

The court of Judicial Magistrate (First Class) on Saturday granted bail to the three accused in a case of dowry death of a 27-yearold lab technician as the Dattawadi police failed to file a charge sheet within the stipulated period of 60 days from the day of arrest.

The court has issued a notice to the investigating officer (IO) asking him to explain as to why the chargesheet was not filed within the prescribed time limit.

The police have been asked to give specific reasons supported by an affidavit within seven days of issuing the order. In case the police fail to respond, it will be presumed that the IO has nothing to say and suitable action would be taken, the order states. The incident took place on September 21 this year.

Shehwar Zaheer Shaikh had committed suicide by strangulating herself at her residence in Dattawadi following harassment by her in-laws. The court granted bail to Shehwar’s husband Zaheer Jafir Shaikh (35), who works at Mahindra- Hinoday in Bhosari MIDC, her brother -in-law Sameer Jafir Shaikh (23 ), both residents of Dattawadi and her sister-in-law Shahista Shrafuddin Inamdar (28), a resident of Lohegaon.
 
Shehwar’s mother-in-law Husena Shaikh, who was also arrested, had already been granted an interim anticipatory bail. According to the police, the accused had allegedly asked Shehwar to bring Rs 2 lakh from her father as they wanted to buy a new home. Shehwar knew that her father, who is an auto driver, would not be able to give the money and took the extreme step.

Altaf Abdul Kadar Shaikh (50), Shehwar’s father, had filed the FIR with the Dattawadi police station. The accused were arrested on September 24. They were charged under various sections of the IPC.

Victim’s counsel Advocate Faiyaz K Shaikh said, “We will file a petition against the police for showing a lackadaisical approach in investigating the case. It appears the police did this deliberately.” Refusing to divulge details, Police Inspector D S Arve (crime) of Dattawadi police station, said, “We will study the case and respond to the court’s order.”
